Trademark

We have litigated in the industries of music, publishing, and toys, including enforcing the BARBIE® trademark against Internet infringements.

We litigate claims involving:

  • trademark infringement,

  • trademark dilution,

  • grey market goods, and

  • cybersquatting.

We have some of the first decisions after trial under:

  • the Federal Anti-Dilution Act of 1998, codified at 15 U.S.C. §1125(d), and

  • the Federal Anti-Cybersquatting Act of 2000. 

 

Patent

We represented the Petitioners in the United States Supreme Court in Global-Tech Appliances Inc. v. SEB S.A., 563 U.S. 764 (2011).

We have represented a patent owner in a series of related design patent infringement actions against its United States distributor and foreign competitor.  A first action resulted in a judgment for $2.35 million against the United States distributor.  A second action resulted in a finding of liability against the foreign competitor, and settled for $1.8 million while awaiting a trial on damages.
